The High Court in Montenegro has reaffirmed its decision regarding the extradition of Do Kwon, co-founder of Terraform Labs, amidst a legal battle between the United States and South Korea. Despite the court’s approval for extradition, the destination country remains uncertain, with ambiguity surrounding whether Kwon will be sent to the US or South Korea.
The extradition saga surrounding Do Kwon, a central figure in the Terra Luna cryptocurrency crash, has been marked by conflicting rulings and jurisdictional disputes. Previous court rulings favored extradition to South Korea, only to face resistance from Montenegrin prosecutors and subsequent requests for review.
Following a demand for review from prosecutors, the Supreme Court intervened, citing procedural irregularities in the extradition process. The court overturned the initial extradition ruling to South Korea, emphasizing the need for a comprehensive evaluation by the High Court in Podgorica. Despite this, the final decision on Kwon’s extradition destination lies with Minister of Justice Andrej Milovic.
The involvement of the United States in seeking Kwon’s extradition underlines the complexity of the legal proceedings. While the Supreme Court’s decision places the US in a favorable position, the ultimate determination of Kwon’s extradition destination rests with the competent minister, highlighting the importance of legal protocol in such matters.
